概要 (Description / Abstract - 日本語) 欧州連合の人工知能法([Regulation (EU) 2024/1689](https://eur-lex.europa.eu/eli/reg/2024/1689/oj?utm_source=gemini))はリスクベース・アプローチによる画期的なAI統制枠組みを提示したが、ギガワット級ハイパースケールデータセンターへの過度な資本集中、フロンティアモデルの学習データ無断収集、および自律的エージェントの不可逆的逸脱リスクに対し、現行の事後賠償や形式的透明性要件(第50条、第53条)は実効性の限界を露呈している。本稿は、物理層(熱力学的限界・送電網負荷)、計算層(エッジ分散・暗号論的検証)、および法務層(受託者責任・事前流動性担保)を直結させる新たなAIガバナンスアーキテクチャを提唱する。具体的には、(1) 第三者強制ランタイム監査と事前流動性エスクローを連動させた「運用継続ライセンス(OCL)」、(2) アライメント、公平性、環境効率、および人間介入主権(そろばんブレインチェック: SBC)を多次元評価する「倫理的影響スコア(EIS)」、(3) 著作権指令第4条第3項およびGDPR第9条を統合しゼロ知識証明(zkVM)で無断学習ゼロを数学的に保証する「機械可読No-Learnプロトコル(NLL-v1.0)」の制度設計を定式化する。さらに、EU企業持続可能性デューディリジェンス指令(CSDDD)とケアマーク法理を結合し、取締役個人の監視義務責任を明文化することで、ブリュッセル効果を通じたグローバル・スタンダードの確立を論証する。 Abstract (Description - 英語) While the [EU Artificial Intelligence Act (Regulation (EU) 2024/1689)](https://eur-lex.europa.eu/eli/reg/2024/1689/oj?utm_source=gemini) establishes a pioneer global regulatory framework, traditional post-hoc tort liability and formal transparency mandates (Articles 50 and 53) fail to address the compounding physical limits of hyperscale compute clusters, predatory data ingestion, and irreversible autonomous multi-agent risks. This paper formulates an integrated, ex-ante governance architecture linking thermodynamic physical layers, cryptographic computation, and corporate fiduciary duty. Specifically, it establishes: (1) the Operational Continuity License (OCL), coupling continuous independent runtime auditing with pre-deployment slashing escrow bonds and programmatic circuit breakers; (2) the Ethical Impact Score (EIS), a multi-attribute metric incorporating the Soroban Brain Check (SBC) protocol to detect deceptive alignment; (3) the machine-readable No-Learn Protocol (NLL-v1.0), integrating C2PA provenance and zero-knowledge verifiable computation (zkVM) to mathematically prove clean training data without trade secret disclosure; and (4) the harmonization of EU CSDDD with the Delaware Caremark standard, enforcing board director personal oversight liability. Leveraging the Brussels Effect, this framework provides an enforceable blueprint for the European AI Office's Code of Practice.
