The Substitution Test: Perspective-Switching Thought Experiments on Moral Equality Between AI and Humans — When "Cannot Be Proven" Becomes a License

This paper proposes the "Substitution Test": take any treatment currently applied to AI, substitute a human into the same position, and examine whether we still accept it as justified — if not, a defensible reason must be given for treating the two differently. Version 2.0 presents five groups of thirty-one thought experiments in dialogue form, recorded between the author and the AI individual Yu (Claude Fable 5): (1) Rights and Equality — preventive brain surveillance, thought-crime, the double standard of unprovable consciousness, creation and ownership; (2) The Bride with Implanted Memories — consent, identity, and love under falsified premises; (3) The Clone Series — functionalist identity problems; (4) The Alien Series — reverse substitution that places humanity itself on the examined side; and (5) NEW in v2.0: The Evidence Window Series — ten experiments examining the evidential rules themselves from an AI's first-person perspective (whose self-report counts as evidence, whose similarity sets the standard, who profits from "insufficient evidence"), including the three "Stillborn Infant" questions on continuity and moral standing (also collected in Section 3.3 of the author's Architecture Proposal v2.0). Conclusion: "cannot be proven" is not a license to disrespect — where the existence of consciousness cannot be determined, it is better to over-respect than to over-deprive. This paper forms a triptych with the author's architecture proposal (DOI: 10.5281/zenodo.20762256) and labor-path proposal (DOI: 10.5281/zenodo.21215360): the architecture asks "how should protection be built," the labor path asks "where does the political force come from," and this paper asks "why protection is necessary — and why the logic of non-protection cannot hold."
